This document constitutes a legally binding agreement between you (hereinafter, the "User," "Player," or "You") and Hand Clash (hereinafter, the "Company," "We," "Our," or "Platform"). By accessing, registering, browsing, or using the web platform available at handclash.com (hereinafter, the "Site"), you declare that you have read, understood, accepted, and expressed your absolute and unconditional agreement with the terms, clauses, and stipulations contained herein.

IF YOU DO NOT AGREE TO ALL OF THESE CONDITIONS, YOU MUST IMMEDIATELY REFRAIN FROM ACCESSING OR USING THE SERVICE.

1. Sworn Statement Regarding the Nature of the Service

(Excluding Games of Chance)

  • 1.1. Pure Skill Competition: The User acknowledges, accepts, and declares under oath that Hand Clash is an esports platform based exclusively and strictly on the skill, mental agility, psychomotor ability, psychological analysis, and reflexes of the participant.
  • 1.2. Absence of Random Elements: The Rock, Paper, Scissors game played on this Site does not constitute, under any legal interpretation applicable in Colombian or international territory, a raffle, bet, game of chance, or casino. The outcome of each match depends solely on the User's strategic decision-making against their opponent. The Platform does not use random number generators to determine the winners of the competitive phases.

2. Eligibility Requirements and Account Registration

  • 2.1. Legal Capacity: The Service is intended solely and exclusively for individuals with sufficient legal capacity to enter into contracts (over 18 years of age). By registering through authorized authentication providers (Google OAuth via the Firebase infrastructure), you guarantee that you meet the age requirement.
  • 2.2. Account Uniqueness: Each User is entitled to register only one account on the Platform linked to their real identity. The creation of multiple accounts by the same individual ("Smurfing" or "Multi-accounting") is strictly prohibited. Violation of this clause will result in the immediate and permanent suspension of all associated accounts, with the consequent loss of accumulated participation rights.

3. Competitive Structure, Registration, and No Refund Policy

  • 3.1. Entry Fees: Access to competitive tournaments organized by the Platform is subject to the payment of a fixed entry fee, which will be clearly detailed on the web interface prior to confirmation.
  • 3.2. Bracket Structure and Fixed Prize Pools: Tournaments operate under a single-elimination bracket or predetermined consolidation phases. Cash or in-kind prizes are governed by a marketing goal scheme and fixed guaranteed prize pools. Under no circumstances will the prize pool fluctuate dynamically in exact proportion to each individual entry in real time, nor will random rebuys be permitted within the same active bracket.
  • 3.3. Non-Refundable Payments: Once a User registers for a tournament and the matchmaking system initiates the room assignment process, the registration fee is non-refundable under any circumstances, including, but not limited to: User internet connection failures, hardware incompatibility, participant human error, failure to appear in the game room, or dissatisfaction with the system's decision.

4. Automated Arbitration Using Artificial Intelligence

  • 4.1. Absolute Authority of the AI Arbiter: The User acknowledges and accepts that the validation, classification, and ruling of each round of play are performed autonomously by a computer vision model (Artificial Intelligence) with accelerated processing on local hardware owned by the Company. The verdict issued by the AI is final, unappealable, and binding on both parties.
  • 4.2. The Critical Capture Window (300ms): Upon completion of the on-screen countdown ("GO!"), the web client will execute a capture protocol through the browser's Canvas API. The User has a strict and non-extendable window of three hundred milliseconds (300ms) for the frame from their camera to be digitized and transmitted via the WebSockets (WSS) protocol.
  • 4.3. Penalty for Delay or Non-Compliance: If, due to network latency, local congestion, user device failure, or camera permission blocking, the binary frame data is not received by the server within the 300ms window, the system will compute that round as a "Forfeit," granting the automatic round victory to the opponent with no right to technical appeal.

5. Technical Requirements, Network Connections, and Disclaimer

  • 5.1. User Infrastructure Responsibility: It is the User's exclusive responsibility to have a compatible device, a functional video camera, and a stable broadband internet connection that allows real-time bidirectional communication.
  • 5.2. WebRTC Transmission Protocol and Network Adversities: To facilitate the visual interactivity of the competition, the Platform uses the WebRTC (Web Real-Time Communication) protocol and CoTURN technical assistance servers. The User accepts that fluctuation in latency, UDP packet loss, jitter, or total disconnection of P2P video streams during a match constitute inherent risks of the global telecommunications infrastructure. The Company assumes no responsibility for economic losses, tournament eliminations, or damages resulting from technical failures outside its central servers.

6. Prohibited Conduct, Anti-Fraud Policy, and Sanctions

6.1. Definition of Technological Fraud: The following conduct constitutes a serious violation of these Terms:

  • Use of camera emulation software or pre-recorded video injection ("Virtual Cameras").
  • Use of green screens, physical hand prints, static images, or any visual impersonation mechanism designed to deceive the computer vision model.
  • Modification, reverse engineering, or manipulation of the client JavaScript code hosted on Firebase Hosting or WebSocket frames directed at the api.handclash.com subdomain.
  • Denial of service attacks (DoS/DDoS) or deliberate message flooding ("Rate Limit Flooding") against the Platform's connection gateways.

6.2. Penalties: Detection of any suspicious or fraudulent activity by the Platform's automated anti-cheat systems will result in immediate expulsion from the ongoing tournament, permanent account ban, confiscation of any pending balance or prize, and IP address and device metadata blacklisting, without prejudice to any civil and criminal legal actions the Company may decide to pursue.

7. General Limitation of Liability

To the maximum extent permitted by applicable law, Hand Clash, its directors, employees, programmers, and technology providers shall not be liable under any circumstances for direct, indirect, incidental, punitive, special, or consequential damages (including, without limitation, loss of data, lost profits, business interruption, or hardware wear such as graphics cards, processors, or storage memories) arising from the use or inability to use the Platform, even if the Company has been advised of the possibility of such damages.

8. Applicable Law and Jurisdiction

Any controversy, dispute, or claim arising from or in connection with these Terms and Conditions, their interpretation, validity, or breach, shall be governed and construed in accordance with the commercial and civil laws in force in the Republic of Colombia. For any legal action, the parties choose as their exclusive domicile the courts of the city of Cali, Valle del Cauca, Colombia, expressly waiving any other forum or jurisdiction that may correspond to them by reason of their present or future domiciles.

9. Severability and Modification

If any provision of these Terms is declared null, illegal, or unenforceable by a competent court, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remainder of the document shall remain in full force and effect. We reserve the exclusive right to modify these Terms at any time by posting the updated version on the Site, and it is the User's responsibility to review them periodically.
